Pourtant, l\u2019<\/span><a href=\"https:\/\/nationalpost.com\/opinion\/opinion-why-our-toothless-competition-bureau-cant-go-after-big-tech\"><span data-contrast=\"none\">inoffensive<\/span><\/a> <i><span data-contrast=\"auto\">Loi sur la concurrence<\/span><\/i><span data-contrast=\"auto\"> est en partie responsable des <\/span><a href=\"https:\/\/openmedia.org\/article\/item\/why-our-sky-high-wireless-bills-dont-make-sense\"><span data-contrast=\"none\">factures sal\u00e9es de nos cellulaires<\/span><\/a><span data-contrast=\"auto\">, du <\/span><a href=\"https:\/\/globalnews.ca\/news\/4404502\/chequing-account-bank-fees-ratehub-canada\/\"><span data-contrast=\"none\">co\u00fbt<\/span><\/a><span data-contrast=\"none\"> excessif des frais bancaires<\/span><span data-contrast=\"auto\">, de la <\/span><a href=\"https:\/\/globalnews.ca\/news\/8428651\/canada-food-price-report-2022\/\"><span data-contrast=\"none\">hausse<\/span><\/a><span data-contrast=\"none\"> du prix des aliments<\/span><span data-contrast=\"auto\"> et m\u00eame de l\u2019<\/span><a href=\"https:\/\/www.bnnbloomberg.ca\/company-news\/video\/dye-durham-has-raised-fees-to-process-real-estate-transaction-by-nearly-900-since-jan-2021~2373760\"><span data-contrast=\"none\">explosion<\/span><\/a><span data-contrast=\"none\"> des prix de l\u2019immobilier<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les politiques de concurrence forment un domaine herm\u00e9tique traditionnellement <\/span><a href=\"https:\/\/www.regs2riches.com\/p\/-seven-reasons\"><span data-contrast=\"none\">r\u00e9serv\u00e9<\/span><\/a><span data-contrast=\"auto\"> aux \u00e9conomistes et aux avocats. Nous devons savoir si les supermarch\u00e9s <\/span><a href=\"https:\/\/twitter.com\/doctorow\/status\/1488907994649800707?s=20&amp;t=OwaZ6XywE8U7mNDWla44mQ\"><span data-contrast=\"none\">prennent pr\u00e9texte de l\u2019inflation<\/span><\/a><span data-contrast=\"auto\"> pour augmenter leurs prix et leurs marges. Et nous devons adopter une strat\u00e9gie plus globale qui renforce la <\/span><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-34\/\"><i><span data-contrast=\"none\">Loi<\/span><\/i><\/a><i><span data-contrast=\"none\"> sur la concurrence<\/span><\/i> <a href=\"https:\/\/vivicresearch.ca\/assets\/PDFS\/Competition-Data-Driven-Markets-Final-Report-2022.pdf\"><span data-contrast=\"auto\">avec instruments l\u00e9gislatifs compl\u00e9mentaires, notamment en mati\u00e8re de protection des consommateurs et de la vie priv\u00e9e, et m\u00eame de nouvelles lois du travail qui prot\u00e8gent les salari\u00e9s contre le \u00ab\u202fpouvoir de monopsone\u202f\u00bb, c\u2019est-\u00e0-dire le pouvoir de march\u00e9 que les entreprises exercent sur les salaires. Un exemple bien connu est <\/span><\/a><a href=\"https:\/\/www.fastcompany.com\/90352975\/why-monopsonies-not-monopolies-are-the-tech-industrys-biggest-threat\"><span data-contrast=\"none\">Uber, dans<\/span><\/a><span data-contrast=\"none\"> l\u2019\u00e9conomie \u00e0 la demande<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">L\u2019argument des gains d\u2019efficience, souvent d\u00e9battu, est devenu une forme d\u2019\u00e9chappatoire invoqu\u00e9 par les entreprises pour justifier les fusions les plus n\u00e9fastes. Cette carte blanche <\/span><a href=\"https:\/\/globalnews.ca\/news\/8392113\/crtc-rogers-shaw-hearings-begin\/\"><span data-contrast=\"none\">facilitera sans doute la fusion Rogers-Shaw,<\/span><\/a><span data-contrast=\"auto\"> qui \u00e9liminerait un concurrent sur le march\u00e9 d\u00e9j\u00e0 restreint des t\u00e9l\u00e9communications, ce qui se r\u00e9percuterait ensuite sur des millions de citoyens. M\u00eame le Bureau de la concurrence a r\u00e9cemment <\/span><a href=\"https:\/\/www.competitionbureau.gc.ca\/eic\/site\/cb-bc.nsf\/eng\/04621.html\"><span data-contrast=\"none\">affirm\u00e9<\/span><\/a><span data-contrast=\"auto\"> que \u00ab\u202fles gains d\u2019efficience ne devraient pas \u00eatre privil\u00e9gi\u00e9s dans l\u2019examen des fusions\u202f\u00bb, ce qui est \u00e0 la fois radical et nouveau pour le Canada. Or, des g\u00e9ants du num\u00e9rique ou des donn\u00e9es \u2013 comme Amazon ou Shopify \u2013 prosp\u00e8rent sans \u00e9gard \u00e0 nos fronti\u00e8res et aux organismes de r\u00e9glementation. En cette \u00e8re num\u00e9rique, les raisons servant \u00e0 justifier la propension canadienne aux regroupements et aux oligopoles ont ainsi perdu toute l\u00e9gitimit\u00e9.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Trois ingr\u00e9dients manquants<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Trois ingr\u00e9dients permettront d\u2019enrichir le d\u00e9bat sur la modernisation du droit de la concurrence\u202f: des \u00e9tudes de cas concrets, une analyse guid\u00e9e par les donn\u00e9es et des id\u00e9es innovantes. On ne les retrouve qu\u2019en quantit\u00e9 limit\u00e9e, mais ils sont d\u2019une redoutable efficacit\u00e9<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Une \u00e9tude de cas \u00ab\u202fen temps r\u00e9el\u202f\u00bb met pr\u00e9sentement \u00e0 l\u2019\u00e9preuve la tol\u00e9rance des consommateurs \u00e0 l\u2019\u00e9gard des fusions. Il s\u2019agit des <\/span><a href=\"https:\/\/www.theglobeandmail.com\/business\/article-dye-durham-announces-more-price-hikes-on-canadian-clients\/\"><span data-contrast=\"none\">hausses de prix monopolistique<\/span><\/a><span data-contrast=\"none\">s<\/span> <span data-contrast=\"auto\">de<\/span> <span data-contrast=\"auto\">l\u2019entreprise de logiciels juridiques Dye &amp; Durham, dont certaines ont atteint <\/span><a href=\"https:\/\/www.theglobeandmail.com\/business\/article-dye-durham-ceo-defends-controversial-price-hikes\/\"><span data-contrast=\"none\">900\u202f% en un an.<\/span><\/a><span data-contrast=\"auto\"> Le Royaume-Uni examine actuellement l\u2019historique de fusions de l\u2019entreprise. Si le Canada fait de m\u00eame, Dye &amp; Durham invoquera sans doute l\u2019<\/span><a href=\"https:\/\/www.mondaq.com\/canada\/antitrust-eu-competition-\/927172\/the-efficiencies-defence-here-we-go-again\"><span data-contrast=\"none\">argument<\/span><\/a><span data-contrast=\"none\"> des gains d\u2019efficience<\/span><span data-contrast=\"auto\"> et continuera d\u2019augmenter ses tarifs. Les m\u00e9dias ont soulign\u00e9 comment les activit\u00e9s de l\u2019entreprise haussaient les frais des avocats en droit immobilier, sans pr\u00e9ciser qu\u2019elles montraient surtout la faiblesse du droit de la concurrence.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Un autre exemple r\u00e9cent qui a fait douter de l\u2019approche canadienne est celui de la <\/span><a href=\"https:\/\/www.regs2riches.com\/p\/-a-garbage-merger\"><span data-contrast=\"none\">fusion<\/span><\/a><span data-contrast=\"auto\"> entre Tervita et Secure Energy Services, deux entreprises albertaines des secteurs de l\u2019\u00e9nergie et de la gestion des d\u00e9chets. Le <\/span><a href=\"https:\/\/www.ct-tc.gc.ca\/en\/home.html\"><span data-contrast=\"none\">Tribunal<\/span><\/a><span data-contrast=\"none\"> de la concurrence<\/span><span data-contrast=\"auto\"> a jug\u00e9 qu\u2019elle causerait un pr\u00e9judice irr\u00e9parable au processus concurrentiel, dans une d\u00e9cision qui a d\u00e9taill\u00e9 les lacunes actuelles du contr\u00f4le des fusions. Les Canadiens approuveraient, puisque 88\u202f% d\u2019entre eux <\/span><span data-contrast=\"none\">croient<\/span><span data-contrast=\"auto\"> qu\u2019il faut stimuler la concurrence et qu\u2019il est trop facile pour les grandes entreprises d\u2019exploiter les consommateurs.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">L\u2019absence d\u2019un programme national de recherche sur les enjeux de concurrence prive le Canada d\u2019indicateurs actualis\u00e9s sur la question, alors m\u00eame qu\u2019on<\/span><span data-contrast=\"auto\"> observe des signes de regroupement parmi les entreprises canadiennes (rapport <\/span><a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3357041#:~:text=We%20find%20that%20the%20concentration,in%20HHI%20of%20over%2040%25.\"><i><span data-contrast=\"none\">Are Industries Becoming More Concentrated? The Canadian Perspective<\/span><\/i><\/a> <span data-contrast=\"none\">de l\u2019Universit\u00e9 York, 2019). Depuis 30 ans, le rythme des d\u00e9marrages d\u2019entreprise <\/span><a href=\"https:\/\/www.ic.gc.ca\/eic\/site\/061.nsf\/eng\/h_03075.html\"><span data-contrast=\"none\">a<\/span><\/a><span data-contrast=\"none\"> diminu\u00e9 de moiti\u00e9<\/span><span data-contrast=\"none\">. Chaque ann\u00e9e, de moins en moins de Canadiens se lancent donc \u00e0 leur compte en tant qu\u2019acteurs ind\u00e9pendants de notre syst\u00e8me \u00e9conomique.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Beaucoup de<\/span><a href=\"https:\/\/howardwetston.sencanada.ca\/competition-consultation\/submissions\/\"> <span data-contrast=\"none\">nouvelles voix<\/span><\/a><span data-contrast=\"auto\"> plaident pour une refonte de la <\/span><i><span data-contrast=\"auto\">Loi sur la concurrence<\/span><\/i><span data-contrast=\"auto\">, dont la derni\u00e8re r\u00e9vision remonte \u00e0 2008. C\u2019est l\u2019ann\u00e9e du lancement de l\u2019App Store, aujourd\u2019hui sous <\/span><a href=\"https:\/\/www.theinformation.com\/articles\/apple-amazon-google-and-facebook-face-at-least-70-antitrust-probes-cases?rc=7hplry\"><span data-contrast=\"none\">enqu\u00eate<\/span><\/a><span data-contrast=\"none\"> antitrust<\/span><span data-contrast=\"auto\"> dans plusieurs pays qui examinent ses activit\u00e9s en mati\u00e8re de <\/span><a href=\"https:\/\/www.voanews.com\/a\/silicon-valley-technology_apple-faces-trial-over-its-app-store-gatekeeper\/6205349.html\"><span data-contrast=\"none\">contr\u00f4le<\/span><\/a><span data-contrast=\"none\"> d\u2019acc\u00e8s<\/span><span data-contrast=\"auto\">, de <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_21_2061\"><span data-contrast=\"none\">restriction des modes de paiement<\/span><\/a><span data-contrast=\"auto\"> et d\u2019auto-pr\u00e9f\u00e9rence, ce qui arrive lorsqu\u2019une plateforme qui vend les produits d\u2019autres commer\u00e7ants donne priorit\u00e9 aux siens.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">L\u2019examen des r\u00e9percussions de ces enjeux sur notre r\u00e9gime de concurrence exhortera aussi nos d\u00e9cideurs \u00e0 \u00e9tudier l\u2019application de nouvelles normes de concurrence internationales \u00e0 des entreprises comme Shopify, qui pourrait abuser de sa position dominante en exigeant de ses clients qu\u2019ils utilisent son propre syst\u00e8me <\/span><a href=\"https:\/\/www.shopify.ca\/blog\/shop-pay-checkout\"><span data-contrast=\"none\">Shop Pay<\/span><\/a><span data-contrast=\"auto\"> de traitement des paiements.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Il est toutefois improbable qu\u2019on examine avant longtemps la situation des licornes canadiennes, m\u00eame si le ministre de l\u2019Innovation, des Sciences et du D\u00e9veloppement \u00e9conomique (ISDE) s\u2019est r\u00e9cemment <\/span><a href=\"https:\/\/twitter.com\/FP_Champagne\/status\/1491077560629067776\"><span data-contrast=\"none\">engag\u00e9 \u00e0 d\u00e9poussi\u00e9rer<\/span><\/a><span data-contrast=\"auto\"> la <\/span><i><span data-contrast=\"auto\">Loi sur la concurrence<\/span><\/i><span data-contrast=\"auto\">. La raisons est la <\/span><a href=\"https:\/\/betakit.com\/free-boswell-canadas-anti-competitive-policy\/\"><span data-contrast=\"none\">faible<\/span><\/a><span data-contrast=\"none\"> ind\u00e9pendance<\/span><span data-contrast=\"auto\"> du Bureau de la concurrence, qui est rattach\u00e9 \u00e0 ISDE, o\u00f9 il applique la loi \u00e0 des entreprises qui contribueraient autrement \u00e0 la croissance du pays en tant qu\u2019innovateurs.
